Primero. REVOCAR la sentencia proferida por el Juzgado
Primero. Civil del Circuito de El Banco Magdalena, el 17 de enero de 2001. En su lugar, CONCEDER el amparo solicitado por la senora Maria Margoth Turizo Martinez, con base en las consideraciones aqui expuestas.
Segundo. ORDENAR al Director de la E.S.E. Hospital La Candelaria de El Banco, Magdalena, para que en el termino de cuarenta y ocho (48) horas contadas a partir de la notificacion de la presente sentencia, proceda, si aun no lo hubiere hecho, a cancelar la totalidad de los salarios adeudados a la tutelante.
En el evento que el ente de salud accionado no disponga de los recursos suficientes en la debida apropiacion presupuestal, contara con el termino anteriormente senalado para iniciar las gestiones tendientes a la obtencion de los recursos economicos que le permitan cumplir en su totalidad con el pago de los salarios adeudados, para lo cual dispondra de un termino maximo de tres (3) meses.
Tercero. PREVENIR al ente demandado para que en el futuro evite incurrir en las omisiones que generaron la instauracion de la presente accion de tutela.
Cuarto. Librense por Secretaria General, las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
