- Primero. CONFIRMAR, pero por las razones expuestas, los fallos proferidos por el Juzgado Penal del Circuito de El Carmen de Bolivar y por la Sala Penal de Decisión del Tribunal Superior del Distrito Judicial de Cartagena los días 14 de junio y 13 de julio de 1994, respectivamente.
- Segundo. OFICIESE al Ministerio del Medio Ambiente para que, dentro de la órbita de sus atribuciones, verifique si en la zona han sido observadas las disposiciones ambientales y adopte las medidas tendientes a preservar los recursos naturales.
- Tercero. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
