- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. Confirmar el fallo del Juzgado Civil del Circuito de Santa Rosa de Cabal (Risaralda), por medio del cual se negó la tutela ejercida por José Iván Gómez contra Alba Inés Villada.
- Segundo. La Defensoría de Familia de Dosquebradas, Centro Zonal No. 3 o al que corresponda, mantendrá la debida vigilancia sobre las menores Dora Luz y Jorge Iván a efecto de que en el futuro no corra peligro su integridad física o moral, pues, de lo contrario habrá de adoptar oportunamente las medidas que provean a corregir tal situación en desarrollo del principio del interés superior del menor.
- Tercero. Comuníquese a la Defensoría a que se refiere el numeral 2o. anterior, con entrega de copias de este fallo.
- Cuarto. Comuníquese al Juzgado Civil del Circuito de Santa Rosa de Cabal (Risaralda), la presente sentencia para que sea notificada a las partes conforme a lo dispuesto en el artículo 36 del Decreto 2591 de l991, con entrega de copia de la misma.
