- Primero. REVOCAR la sentencia proferida por el Juzgado Ochenta y ocho Penal Municipal de Santa Fe de Bogotá, el 30 de julio de 1996.
- Segundo. CONCEDER la tutela solicitada. En consecuencia, se ordena al Director del Hospital La Perseverancia que, en el término de un (1) mes, contado a partir de la notificación de esta sentencia, proceda a efectuar el nombramiento de Luz Helena Montenegro Alvarez en el cargo de Jefe Grupo 1, Profesional Universitario-8 horas, de acuerdo con el resultado del concurso abierto efectuado según convocatoria No. 011 del 17 de julio de 1995.
- Tercero. LIBRENSE, por Secretaría, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
