- PRIMERO. REVOCAR la sentencia del 18 de mayo de 1994, proferida por el H. Consejo de Estado, Sala de los Contencioso Administrativo, Seccion Segunda.
- SEGUNDO. CONFIRMAR la sentencia del 13 de abril de 1994, proferida por el Tribunal Administrativo de Cundinamarca, Seccion Primera, mediante la cual se concedio la tutela solicitada.
- TERCERO. ADICIONAR la sentencia de dicho Tribunal en el sentido de que la tutela a que se refiere el punto anterior, queda condicionada a la circunstancia de que la peticionaria de la tutela hubiera hecho uso de la correspondiente accion contencioso administrativa dentro del plazo legal, contado a partir de la decision cuestionada (oficio 08828 del 23 de marzo de 1993), y que la medida de tutela estara vigente mientras se falle el correspondiente proceso.
- CUARTO. LIBRESE comunicacion al Tribunal Administrativo de Cundinamarca, Seccion Primera, a efecto de que se surtan las notificaciones de este fallo, conforme lo establecido en el articulo 36 del Decreto 2501 de 1991.
