- PRIMERO. REVOCAR la sentencia del 13 de marzo de 1992, proferida por el Consejo de Estado, Sala Plena de lo Contencioso Administrativo, confirmatoria del fallo de tutela proferido por el Tribunal Administrativo de Cundinamarca, Sección Primera del 13 de febrero de 1992.
- SEGUNDO. CONCEDER la tutela solicitada por el señor PRUDENCIO TOLOSA SUAREZ en representación del señor JORGE ENRIQUE TOLOSA y en agenciamiento oficioso de la señora MARIA CLEMENCIA LEIVA DE TOLOSA y, en consecuencia, ORDENAR al Ministerio de Relaciones Exteriores, expedir el documento de "declaración de no objeción" al cambio de visa J-1 a H-1 en favor de los señores JORGE ENRIQUE TOLOSA y MARIA CLEMENCIA LEIVA y disponer su tramitación a través de la Embajada de la República de Colombia ante los Estados Unidos de América con destino a las autoridades competentes de dicho país.
- TERCERO. LIBRESE comunicación al Tribunal Administrativo de Cundinamarca, Sección Primera, con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
