- Primero. INAPLICAR para el caso concreto, por ser manifiestamente inconstitucional, el Acuerdo 106/96 expedido por el Consejo Superior de la Judicatura -Sala Administrativa.
- Segundo. CONFIRMAR la sentencia de fecha 23 de octubre de 1997 proferida por el H. Consejo de Estado -Sección Primera- Sala de lo Contencioso Administrativo, que revocó la sentencia del 18 de septiembre de 1997 dictada por el Tribunal de lo Contencioso Administrativo de Caldas.
- Tercero. Ordenar que por el Tribunal de lo Contencioso Administrativo de Caldas, se adopten las medidas del caso para restablecer las cosas al estado que tenían cuando se presentó la demanda de tutela.
- Cuarto. Por Secretaría, líbrense las comunicaciones que señala el Artículo 36 del Decreto 2591 de 1991.
