- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E
- PRIMERO. Revocar la sentencia del Tribunal Administrativo de Bolívar, proferida el tres (3) de Mayo de mil novecientos noventa y tres (1993), mediante la cual se negó la acción de tutela propuesta por el señor Carlos Gabriel NG. Ching en nombre de su hermano RUBEN VISUN NG. CHING.
- SEGUNDO. Conceder al señor RUBEN VISUN NG. CHING, la tutela de los derechos fundamentales a la salud y a la igualdad.
- TERCERO. Ordenar a la Dirección de Sanidad del Ejército que, en el término de un (1) mes a partir de la notificación de esta providencia, proceda, teniendo en cuenta los criterios consignados en la parte motiva de esta sentencia, a hacer una nueva evaluación de la capacidad laboral del exsoldado, en la cual valore la lesión ocurrida en el servicio y por causa del mismo, así como las secuelas en su salud mental, derivadas de su ocurrencia, y luego por la autoridad competente, se defina formalmente, mediante la expedición del correspondiente acto administrativo, lo que corresponda, según la ley, en cuanto al reconocimiento y pago, de los derechos prestacionales especiales que eventualmente puedan corresponderle al exsoldado Rubén Visun Ng. Ching.
- CUARTO. Comuníquese la presente providencia al Tribunal Administrativo de Bolívar, para los fines establecidos en el artículo 36 del Decreto 2591 de 1991.
