- Primero. REVOCAR las sentencias proferidas por el Consejo de Estado el 22 de enero de 1998, y el Tribunal Administrativo del Magdalena el 8 de octubre de 1997; en su lugar, se ordena al Tribunal mencionado que, dentro de las cuarenta y ocho (48) horas siguientes a la comunicacion de esta providencia, disponga la notificacion al actor del contenido de este fallo, y del auto por medio del cual, esa Corporacion le imprime a la demanda el tramite previsto en la Ley 393 de 1997 para la accion de cumplimiento.
- Segundo. TUTELAR el derecho al debido proceso administrativo violado al actor por la Direccion General Maritima, y ordenar a esta que inaplique el acto administrativo por medio del cual se revoco irregularmente la designacion de la firma Servicios Tecnicos Maritimos Ltda. como encargada de avalar y llevar a cabo el entrenamiento del actor.
- Tercero. COMUNICAR esta sentencia al Tribunal Administrativo del Magdalena para los fines previstos en el articulo 36 del Decreto 2591 de 1991, y en los numerales anteriores.
