Derecho al minimo vital de madre e hija recien nacida afiliada al regimen contributivo del sistema general de seguridad social a quien la entidad le niega el reconocimiento de la licencia de maternidad aduciendo el pago de cotizaciones del empleddor por fuera de los plazos limite establecidos en la ley.
Procedencia de la accion de tutela para reclamar el pago de la licencia de maternidad como quiera que la accion fue instaurada dentro del plazo de que trata la jurisprudencia constitucional y esta comprometido el minimo vital de quien acciona.

- Primero. REVOCAR por las razones expuestas en este Fallo, la Sentencia del 4 de octubre de 2004, proferida por el Juzgado Doce Civil del Circuito de Bogota y en consecuencia, CONFIRMAR la providencia proferida por el Juzgado Veinticuatro Civil Municipal de Bogota el dieciseis (16) de junio de 2004, en cuanto concedio la proteccion constitucional del derecho al minimo vital de Martha Liliana Castro Gomez y de su recien nacida hija, Jessica Vanessa Paez Castro.
- Segundo. Librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
