- PRIMERO. REVOCAR la sentencia de fecha 29 de noviembre de 2002, proferida por el Juzgado
- Décimo. Civil del Circuito de Bogotá que a su vez, confirmó lo dispuesto el 15 de octubre de 2002 por el Juzgado Veintiséis Civil Municipal de Bogotá, mediante la cual se negó el amparo solicitado por el Señor Jorge Chilito Rodríguez y en su lugar, se tutela el derecho a la salud en conexidad con el derecho a la vida del peticionario.
- SEGUNDO. ORDENAR a Compensar EPS, para que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo autorice, de conformidad con las indicado por el médico tratante, el aparato respiratorio denominado C.P.A.P que necesita el Señor Jorge Chilito Rodríguez. Esta EPS deberá asumir los costos del mismo y podrá repetir por los gastos adicionales en que incurra contra el Fondo de Solidaridad y Garantía, subcuenta de promoción de la salud.
- TERCERO. Por Secretaría líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
