- Primero. REVÓCASE la sentencia proferida por la Corte Suprema de Justicia, el veintitrés (23) de abril de 2002, en la acción de tutela instaurada por Aydee Galeano Pachón, en la condición de agente oficiosa de su hermano Victor René Galeano Pachon contra la EPS Compensar S.A. En su lugar, CONCÉDASE el amparo solicitado.
- Segundo. En consecuencia, ORDÉNASE a Compensar EPS, que, a más tardar, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, suministre al señor Victor René Galeano Pachón, el implante de stent que requiere,
- Tercera: La EPS Compesar S.A. podrá hacer uso de la acción de repetición en contra del Estado, con cargo al Fondo de Solidaridad y Garantía, para obtener el reintegro de los valores que no está obligado legalmente a asumir.
- Cuarto. Por Secretaría General, LÍBRENSE las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
