- Primero. REVOCAR, de conformidad con lo señalado en la parte motiva, la sentencia de la Corte Suprema de Justicia, Sala de Casación Penal del 16 de mayo de 1995 que confirmó la sentencia del Tribunal del Distrito Judicial de Santafé de Bogotá, Sala Penal del seis de septiembre de mil novecientos noventa y cuatro, por medio de la cual decidió decretar la cesación de la actuación de tutela, y prevenir al Fiscal 172 de las unidades 5º y 6º de Patrimonio Económico de Bogotá para que no vuelva a incurrir en dilaciones, y en su lugar NEGAR, por carencia actual de objeto, la tutela impetrada por el actor CESAR AUGUSTO GOMEZ TORRES.
- Segundo. PREVENIR al Fiscal 172 de las unidades 5º y 6º de Patrimonio Económico de Santafé de Bogotá para que no vuelva a incurrir en dilaciones injustificadas de términos.
- Tercero. COMUNÍQUESE a la Sala Penal del Tribunal del Distrito Judicial de Santafé de Bogotá para que notifique la sentencia a las partes, según lo establecido por el artículo 36 del decreto 2591 de 1991.
