- Primero. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior de Santafé de Bogotá del 18 de febrero de 199, y en su lugar CONCEDER la tutela de los derechos a la vida, la salud y la seguridad social de la señora Eliana Andrea Cely Rodríguez.
- Segundo. ORDENAR al Instituto del Seguro Social E.P.S., que en el término de 48 horas, contadas a partir de la notificación de este fallo, proceda a pagar la licencia de maternidad a la demandante Eliana Andrea Cely Rodríguez.
- Tercero. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
