- PRIMERO. CONFIRMAR la Sentencia proferida por el Juzgado 59 Penal del Circuito de Santa Fe de Bogota, en el sentido de conceder la tutela al derecho de peticion.
- SEGUNDO. REVOCAR la Sentencia proferida por el Juzgado 59 Penal del Circuito de Santa Fe de Bogota, en cuanto no tutelo lo atinente a la proteccion de la familia; y en su lugar, CONCEDER la tutela en lo referente al punto precitado.
- TERCERO. En consecuencia, se ORDENA a la Seccion de Reclutamiento del Ejercito Nacional desacuartelar al joven Juan Carlos Cubillos Hernandez debido a que se encuentra dentro de los supuestos de la exencion del servicio militar obligatorio que consagra el literal c) del articulo 28 de la Ley 48 de 1993.
- CUARTO. COMUNICAR a traves de la Secretaria General de la Corte Constitucional el contenido de la sentencia al Juzgado 59 Penal del Circuito de Santa Fe de Bogota, a la Seccion de Reclutamiento del Ejercito Nacional, al Defensor del Pueblo y a la peticionaria de la presente tutela.
