- Primero. REVOCAR la totalidad de la sentencia de el Juzgado Penal Municipal, del 5 de noviembre de 1997. En consecuencia, NEGAR la acción de tutela interpuesta por el señor Cesar Enrique Rodríguez Aguilar, por los motivos expuestos en esta providencia.
- Segundo. HACER UN LLAMADO A PREVENCIÓN a las autoridades locales y nacionales, que se mencionarán en el numeral siguiente, para que dentro del término de los 4 años señalados en la sentencia T-153 de 1998, faciliten la colaboración para encontrar soluciones reales al problema carcelario en Fusagasugá, tal y como lo dispone el artículo 113 de la Constitución.
- Tercero. COMUNICAR la presente sentencia a la Directora de la Cárcel del Circuito de Fusagasugá, al Director del INPEC, al Alcalde de Fusagasugá, al Presidente del Concejo de Fusagasugá y al Defensor del Pueblo.
- Cuarto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
