- Primero. CONFIRMAR la sentencia proferida por el Juzgado
- Noveno. Laboral del Circuito de Santafé de Bogotá, el día
- primero. (1) de abril de mil novecientos noventa y tres (1993), en cuanto declaró IMPROCEDENTE la acción de tutela con respecto a las pretensiones del demandante a que se ha hecho referencia en la parte motiva de esta providencia.
- Segundo. MODIFICAR la sentencia mencionada y conceder la tutela por violación del Derecho fundamental de petición y en tal virtud se ordena al INSTITUTO DE LOS SEGUROS SOCIALES resolver la petición elevada por LUIS ALFONSO BARBOSA, dentro del término improrrogable de cuarenta y ocho (48) horas, contado a partir de la notificación de esta sentencia, si para la fecha de esta última no ha sido resuelta la solicitud.
- Tercero. LIBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991 para los efectos allí contemplados.
