A través de la figura de la agencia oficiosa, se instaura la acción de tutela en representación de una mujer de 87 años de edad, con diabetes mellitus, insulinodependiente, hipertensa, antecedentes de demencia vascular, trastornos de deglución y amputación de sus dos piernas.

Se aduce que E.P.S demandada vulneró derechos fundamentales, al no asignarle el cuidador domiciliario que requería.

Teniendo en cuenta que en sede de revisión la Sala conoció que la agenciada falleció, decidió declarar la CARENCIA ACTUAL DE OBJETO por la ocurrencia de un hecho sobreviniente.

PRIMERO. LEVANTAR la suspensión de términos en el proceso de la referencia, de conformidad con las razones expuestas.
SEGUNDO. REVOCAR el fallo proferido el 11 de octubre de 2019 por el Juzgado Promiscuo del Circuito de Caloto (Cauca), que confirmó, a su vez, la sentencia emitida el 27 de septiembre de 2019 por el Juzgado Promiscuo Municipal de Guachené (Cauca), en el sentido de DECLARAR LA CARENCIA ACTUAL DE OBJETO en virtud del hecho sobreviniente que supuso el fallecimiento de la señora María Rosario Balanta Ararat.
TERCERO. Por Secretaría General de esta Corporación, LÍBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
