- Primero. REVOCAR la sentencia materia de revisión y en su lugar, tutelar los derechos a la vida y a la seguridad social de GILBERTO FRANCISCO GUZMAN DIAZ.
- Segundo. ORDENAR al Alcalde Municipal de Riohacha que, si aún no lo ha hecho, reanude el pago de las mesadas pensionales de GILBERTO FRANCISCO GUZMAN DIAZ en el termino máximo de 48 horas contados a partir de la notificación de la presente providencia, so pena de las sanciones previstas en el Decreto 2591 de 1991 para el desacato.
- Tercero. ENVIAR copia del presente fallo a la Procuraduría General de la Nación para los efectos señalados en la parte motiva de esta sentencia.
- Cuarto. COMUNICAR la presente providencia al juzgador de primera instancia para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
