- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Civil del Circuito de Bogotá, el 29 de septiembre de 2003 y, en su lugar, TUTELAR los derechos fundamentales a la salud en conexidad con la vida, a la igualdad, a la dignidad humana y a la seguridad social del señor Jaime Morales Villamil.
- SEGUNDO. ORDENAR al Representante Legal de la Empresa Promotora de Salud del Instituto de Seguros Sociales, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta sentencia, autorice la práctica de los exámenes de Carga Viral y CD4, tal y como fueron ordenados por el médico tratante al paciente Jaime Morales Villamil, si los mismos no hubiesen sido practicados hasta el momento. La práctica de tales exámenes no podrá exceder de ocho días una vez expedida la respectiva autorización.
- TERCERO. DECLARAR que le asiste derecho a la E.P.S. del Instituto de Seguros Sociales de repetir, por lo que pague en cumplimiento de lo establecido en la presente sentencia, a la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (Fosyga). El término para el pago no podrá exceder de veinte (20) días una vez presentada la solicitud.
- CUARTO. LÍBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
