Revocar la sentencia proferida por la Corte Suprema de Justicia, Sala de Casación Civil, de fecha veintiocho (28) de agosto del año dos mil (2000), en la acción de tutela presentada por José Leonidas Mendoza Toloza contra la Gobernación de Santander y el Fondo Territorial de Pensiones de Santander. En consecuencia, se concede la tutela pedida.
Para tal efecto, la Gobernación de Santander y el Fondo Territorial de Pensiones de Santander, si aún no lo hubieren hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, deberán realizar las operaciones presupuestales para garantizar el pago del bono pensional reconocido, y remitir al Instituto de Seguro Social para el trámite pertinente, a favor del demandante. Las gestiones a realizar no podrán exceder el término perentorio de tres meses.
Por Secretaría General líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
