- Primero. REVOCAR el fallo proferido el día 5 de abril del 2000 por parte del Tribunal Superior del Distrito Judicial de Cundinamarca, que a su vez revocó el fallo de 14 de marzo del 2000 dictado por el Juzgado Laboral del Circuito de Girardot.
- Segundo. CONCEDER la acción de tutela impetrada por la señora Martha Esperanza Fuentes contra la empresa Colombiana de Incubación -INCUBACOL S.A. En consecuencia se ordenará a la empresa Colombiana de Incubación -INCUBACOL S.A. a reintegrar a la trabajadora Martha Esperanza Fuentes, en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia al cargo que venía desempeñando, con el pago de los emolumentos dejados de percibir y la indemnización a que haya lugar.
- Tercero. Comunicar la presente Sentencia al Ministerio de Trabajo y Seguridad Social para lo de su competencia.
- Cuarto. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
