- Primero. REVOCAR el fallo proferido por el Juzgado
- Segundo. Civil del Circuito mediante el cual se denegó el amparo solicitado por la actora de sus derechos a la salud y a la vida.
- Segundo. TUTELAR los derechos a la vida y la salud de MARLENY CARDENAS FERNÁNDEZ Y SU HIJA y, en consecuencia, ordenar a la E.P.S Instituto del Seguro Social, Seccional Meta- que una vez realizada la notificación de esta providencia, les haga entrega de los medicamentos formulados por el médico tratante y se les realice la prueba diagnóstica denominada, carga viral.
- Tercero. DECLARAR que la E.P.S. del I.S.S. Seccional Meta, tiene derecho a repetir contra el Ministerio de Salud - Fondo de Solidaridad y Garantía, hasta el monto de los costos en que haya incurrido y que corresponden al Estado, por concepto de cuota de recuperación.
- Cuarto. Por Secretaría General, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
