- PRIMERO. REVOCAR el fallo dictado por el Juzgado Sesenta y Cinco (65) Civil Municipal de Bogota y en su lugar CONCEDER la tutela por los derechos fundamentales a la vida, a la dignidad humana y al minimo vital de la senora Lucenid Gongora Rodriguez.
- SEGUNDO. ORDENAR a la EPS FAMISANAR Seccional Bogota que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de este fallo, si aun no lo ha hecho pague a la senora Lucenid Gongora Rodriguez la licencia de maternidad que se causo el 15 de enero de 2005.
- TERCERO. Por secretaria General librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
