PRIMERO. REVOCAR el fallo proferido por el 19 de Julio de 2003, el Juzgado
Tercero. Civil del Circuito de Sincelejo. En su lugar TUTELAR los derechos fundamentales a la seguridad social y a la salud de la señora LUZ DARY PALENCIA ATENCIA.
SEGUNDO. ORDENAR al INSTITUTO DE SEGURO SOCIAL, Seccional Sucre que realice a en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia la cirugía Tiroidectomía recomendada por el médico tratante de la señora LUZ DARY PALENCIA ATENCIA.
TERCERO. El Instituto de Seguro Social podrá reclamar a la empresa "VIGILAR LTDA." el pago de los aportes adeudados por esta empresa y el porcentaje que corresponda cancelar por los procedimientos médicos que se le practiquen a la señora LUZ DARY PALENCIA ATENCIA según se explicó en la parte motiva de esta sentencia.
CUARTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
