- PRIMERO. REVOCAR el fallo proferido por el Juzgado
- Sexto. Penal Municipal de Santa Marta (Magdalena), por las razones expuestas en esta Sentencia.
- SEGUNDO. CONCEDER la tutela solicitada por el Sr. Marco Tulio Villarreal Escobar a traves de apoderado judicial, por las razones expuestas en esta Sentencia en lo referente al derecho al debido proceso en actuaciones administrativas en cuanto al valor probatorio de las pruebas y al tiempo para decidir la solicitud de pension.
- TERCERO. En consecuencia, el Juzgado
- Sexto. Penal Municipal de Santa Marta ORDENARA a la Caja de Prevision Social del Magdalena, tramitar en el termino de treinta (30) dias la solicitud de pension vitalicia de jubilacion del Sr. Marco Tulio Villarreal Escobar y notificar la resolucion en la que se de respuesta a su peticion.
- CUARTO. NO CONCEDER la tutela en lo referente al otorgamiento de la pension de jubilacion en concreto por ser esta decision de competencia exclusiva de la Caja de Prevision del Departamento del Magdalena.
- QUINTO. COMISIONAR al Juzgado
- Sexto. Penal Municipal de Santa Marta para que vigile el cumplimiento de la decision tomada en la presente Sentencia de Revision e informe a la Corte Constitucional el cumplimiento de la misma.
- SEXTO. ENVIAR copia de esta Sentencia al Ministerio del Trabajo y Seguridad Social la Caja de Prevision Social del Departamento del Magdalena, a las demas Cajas Departamentales y Distritales de Prevision Social del pais, a la Caja Nacional de Prevision Social y al Defensor del Pueblo.
