- Primero. REVOCAR la sentencia de la Sala de Casación Laboral de la Corte Suprema de Justicia de fecha diecisiete (17) de septiembre de mil novecientos noventa y seis (1996), por las razones expuestas, y en su lugar CONFIRMAR la sentencia de la Sala Laboral del Tribunal Superior del Distrito Judicial de Santa Marta, de Fecha veintiuno (21) de agosto de mil novecientos noventa y seis (1996), la cual tuteló el derecho de petición del señor Domingo Guzmán Castro Martínez, y ordenó a la Caja Nacional de Previsión Social, que en el término de cinco (5) días, se pronuncie sobre la solicitud de reconocimiento y pago de la pensión de jubilación realizada por el actor.
- Segundo. LÍBRENSE, por Secretaría, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, en la forma y para los efectos allí contemplados.
