- PRIMERO. REVOCAR las sentencias proferidas por los Juzgados
- Primero. Penal Municipal de El Banco (Magdalena), el 22 de mayo de 2000 y el Juzgado Penal del Circuito de El Banco (Magdalena), el 30 de junio de 2000. En su lugar, CONCEDER la tutela impetrada por Ronelsa Muñoz Oliveros, Olga Lucia Ardila Bandera, Beatriz Elena Bustamante Ochoa, Betty Rios de Rodríguez, Yulieth Patricia Rangel Noriega y Zoraida Rangel Ortíz contra el Municipio de El Banco (Magdalena).
- SEGUNDO. ORDENAR al Alcalde Municipal de El Banco Magdalena, que en el término máximo de un mes contado a partir de la notificación de la presente providencia, si no lo hubiere hecho ya, proceda a cancelar la totalidad de los salarios adeudados a las actoras.
- Si ante el juez de primera instancia, al cual se confía la vigilancia y el control sobre el cumplimiento de este fallo, el Alcalde del Municipio de El Banco Magdalena acreditara dificultades de liquidez o de flujo de caja que le impidan cancelar la totalidad de los salarios adeudados, el mes se concede para que inicie - probándolo ante el juez - los trámites necesarios para la obtención de los recursos que permitan atender en su integridad las aludidas obligaciones en un término que no podrá exceder de tres (3) meses.
- TERCERO. PREVENIR al ente demandado para que en el futuro evite incurrir en las omisiones que generaron la instauración de la presente acción de tutela.
- CUARTO. Por Secretaría líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
