  2. R E S U E L V E :
  3. Primero. REVOCAR las sentencias proferidas, en primera instancia por el Juez Penal del Circuito de Puerto Tejada el 4 de agosto de 1997, y, en segunda instancia por la Sala Penal del Tribunal Superior de Popayán el 28 de agosto de 1997, y en su lugar CONCEDER la tutela , protegiéndose el derecho de petición y en consecuencia se ORDENA que el Alcalde Municipal de Puerto Tejada, en el término de cinco días hábiles, responda mediante acto administrativo a las pretensiones contenidas en el escrito de petición que el
  4. primero. de noviembre de 1996 se le formuló respecto al reconocimiento y pago de sueldos, prestaciones, indemnizaciones y demás derechos laborales que podrían corresponderle a ENER JOSE GOMEZ LASSO; y entregar al solicitante de la tutela copia de la desvinculación laboral, de Gómez Lasso, si es que la hubo.
  5. Segundo. Por Secretaría se librará la comunicación de que trata el artículo 36 del decreto 2591 de 1991, para los efectos del caso.
