- PRIMERO. REVOCAR la providencia proferida por la Sala de Casacion Civil de la Corte Suprema el dia 27 de julio de 1992. En su lugar, ORDENAR el bloqueo inmediato, de toda la informacion concerniente a la obligacion de Alirio Martinez Serna y sus codeudores Ruth Suarez de Martinez y Julian Martinez Suarez almacenada en el banco de datos de la Central de Informacion de la Asociacion Bancaria de Colombia. En consecuencia, no podran divulgarse tales datos economicos personales hasta cuando se profiera la respectiva sentencia en el proceso ejecutivo que actualmente se adelanta contra el peticionario en el juzgado
- Tercero. Civil de Santafe de Bogota.
- SEGUNDO. En todos aquellos casos similares por sus hechos o circunstancias, siempre que hayan ocurrido abuso o intromisiones arbitrarias o ilegales en el almacenamiento, uso y divulgacion no autorizado expresamente de datos personales, por cualquier medio y tecnologia que vulnere o amenace la intimidad y libertad informatica de la persona, la doctrina constitucional enunciada en esta sentencia tendra CARACTER OBLIGATORIO para las autoridades en los terminos del art. 23 del Decreto 2067 de 1991.
- TERCERO. ENVIENSE sendas copias del presente fallo a los senores Procurador de la Nacion, Fiscal General, Defensor del Pueblo, Superintendente Bancario y Director del Departamento Nacional de Estadistica (DANE).
- CUARTO. ORDENAR que por Secretaria se comunique esta providencia a la Sala de Casacion Civil de la Corte Suprema de Justicia en la forma y para los efectos previstos en el articulo 36 del Decreto 2591 de 1991.
