- Primero. Declárase EXEQUIBLE, en el artículo 91, numeral 3, del Código de Procedimiento Civil, reformado por el 1, modificación 42, del Decreto 2282 de 1989, la expresión "...o que sea inhibitoria", únicamente en el entendido de que la ineficacia de la interrupción de la prescripción y la operancia de la caducidad, en su caso, sólo tendrán lugar cuando la sentencia inhibitoria provenga de causas o hechos imputables al demandante.
- Segundo. Declárase EXEQUIBLE el numeral 4 del artículo 333 del Código de Procedimiento Civil.
- Tercero. La exequibilidad de los preceptos enunciados se condiciona, además, en el sentido de que las providencias judiciales inhibitorias únicamente pueden adoptarse cuando, ejercidas todas las atribuciones del juez y adoptadas por él la totalidad de las medidas procesales para integrar los presupuestos del fallo, resulte absolutamente imposible proferir decisión de fondo.
