- PRIMERO. ESTESE A LO RESUELTO por la sala Plena de la Corte Suprema de Justicia en la sentencia No. 109 de septiembre 19 de 1991, en la cual se declararon exequibles los apartes demandados "y asi sucesivamente", pertenecientes a los inciso 1 y 2 del articulo 3 de la ley 50 de 1990, que subrogo el art. 46 del Codigo Sustantivo del Trabajo.
- SEGUNDO. Declarase EXEQUIBLE la expresion "pero es renovable indefinidamente" que hace parte del inciso 1 del referido articulo.
