Demandas de inconstitucionalidad contra los arts. 93, parágrafo 3 (parcial) y 94 inciso 4 (parcial) de la Ley 223 de 1995, "por la cual se expiden normas sobre Racionalización Tributaria y se dictan otras disposiciones".
Los actores señalaron que se desconoció la competencia de los municipios para gravar la propiedad inmueble con cualquier tipo de tributo, ya que la renta presuntiva es una herramienta para imponer impuestos a favor de la Nación y no de los municipios, como lo establece el art. 317 de la Constitución.
La Corte consideró que el cargo formulado no prospera pues el hecho de que la propiedad inmueble haga parte de los activos del contribuyente sobre los cuales la ley consagró de tiempo atrás la renta presuntiva, no significa que ésta constituya un gravamen sobre la propiedad inmueble, que es del resorte exclusivo de los municipios.
La Corte declaró exequible los apartes acusados de los artículos 93 parágrafo 3o. y 94 inciso 4o. de la Ley 223 de 1995.
