- en nombre del Pueblo y por mandato de la Constitución,
- R E S U E L V E:
- DECLARAR INEXEQUIBLE el numeral 2.7 del artículo 1 de la ley 168 de 1994, en lo correspondiente a la partida equivalente a $ 872.8 mil millones de pesos, correspondiente a los recursos incorporados como otros recursos de capital excedentes financieros de la Nación, recaudados en 1994, por concepto de los contratos de concesión a particulares del servicio público de telefonía móvil celular.
- El Gobierno Nacional deberá darle cumplimiento al artículo 15 de la Ley 179 de 1994, a partir de la vigencia fiscal de 1995, en relación con la ejecución de este fallo y para determinar la cuota mínima anual que corresponde distribuir entre las entidades beneficiarias del situado fiscal y de las transferencias a los municipios.
