PRIMERO. Declarar EXEQUIBLE los artículos 267 y 561 de la Ley 522 de 1999 "por medio de la cual se expide el Código Penal Militar", en relación con los cargos examinados.
SEGUNDO. Declarar EXEQUIBLE el artículo 263, numeral 4 de la Ley 522 de 1999 "por medio de la cual se expide el Código Penal Militar", en el entendido de que cuando el auditor de guerra ha actuado en la etapa de instrucción no podrá ejercer funciones de asesoría ni elaborar proyectos de fallo durante la etapa de juzgamiento en el mismo proceso.
