Primero. REVOCAR la sentencia proferida por el Juzgado
Tercero. Laboral del Circuito de Barranquilla, y CONCEDER la tutela por los derechos a la salud en conexidad con la vida de la señora LIBIA GOMEZ VÁSQUEZ.
Segundo. ORDENAR a los médicos de COOMEVA, Seccional Barranquilla, encargados del caso de la señora Libia Gómez Vásquez, que si aún no lo han hecho, procedan a evaluar cuál de los posibles tratamientos aplicables a la operación que la paciente requiere, cuenta con menos riesgos para su vida, dadas sus especiales condiciones de paciente con padecimiento de asma.
Procederá la entidad a operar de conformidad con lo anterior, en un término prudencial, que no exceda de un mes contado a partir de la notificación de esta decisión. Deberá contarse con el consentimiento de la paciente, y no podrá COOMEVA oponer la exclusión del POS de un tratamiento necesario para amparar los derechos de la accionante, en caso de que se opte por la operación a través de video-laparoscopia.
Tercero. Por secretaría, líbrese la comunicación a que se refiere el artículo 36 del decreto 2591 de 1991.
