- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Primero. Civil Municipal de Pasto y en su lugar CONCEDER la tutela a favor de Luis Eduardo Pai en representacion de la senora FLOR ILBA ORTEGA NARVAEZ, por las razones expuestas en el presente fallo.
- SEGUNDO. ORDENAR a la E.P.S. SELVA SALUD S.A. de Pasto, que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, proceda a ordenar el efectivo suministro de oxigeno ordenado por el medico tratante de la senora FLOR ILBA ORTEGA NARVAEZ.
- TERCERO. ORDENAR que en el termino de 5 dias habiles el senor Luis Eduardo Pai junto con su familia haga las diligencias necesarias para ser encuestados por el SISBEN para que vuelva a figurar en la base de datos y se verifique su nivel de pobreza.
- CUARTO. Para los efectos del articulo 36 del decreto 2591 de 1991, el juzgado de origen hara las notificaciones y tomara las medidas conducentes para el cumplimiento de esta sentencia.
