- PRIMERO. CONFIRMAR, pero exclusivamente por las razones expuestas en esta providencia, la sentencia proferida por el Juzgado 26 Penal del Circuito de Bogotá el 1° de abril de 2004, dentro de la tutela instaurada por Rosa Astrid Benavides Nope contra el Colegio Danilo Cifuentes de esta ciudad.
- SEGUNDO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
