Primero. REVOCAR la sentencia de tutela proferida en el expediente T-299306 por el Juzgado
Noveno. Penal Municipal de Barranquilla, por medio de la cual se negó el amparo solicitado por Pedro Colatino Moreno Pinzón. En consecuencia, CONCEDER la tutela solicitada por Pedro Colatino Moreno Pinzón.
Segundo. ORDENAR a la entidad demandada, que dentro del término de cuarenta y ocho (48) horas siguientes a la notificación de ésta providencia, cancele las mesadas adeudadas a los demandantes, siempre y cuando exista partida presupuestal disponible. En caso de que no exista la respectiva partida, deberá realizar las operaciones presupuestales para garantizar las mesadas adeudadas. Dichas gestiones no podrán exceder el término perentorio de tres (3) meses.
Tercero. PREVENIR a la entidad demandada para que cumpla lo dispuesto en éste fallo, so pena de incurrir en desacato, y para que en lo sucesivo no repita la omisión que dio origen a la presente acción.
Cuarto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
