- Primero. REVÓCASE PARCIALMENTE la sentencia del quince (15) de septiembre de mil novecientos noventa y ocho (1998), proferida por el Tribunal Superior de Cali, Sala Civil. En consecuencia, se concede la tutuela solicitada por el señor Luis Eduardo Rosero Zúñiga contra la Universidad del Valle, en cuanto le fue vulnerado el derecho a la igualdad. Se confirma, en relación con la protección al derecho de petición.
- Segundo. ORDÉNASE a la Universidad del Valle a que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, realice todas las gestiones pertinentes para lograr el ingreso a la especialización de oftalmología del médico Luis Eduardo Rosero Zúñiga, a más tardar en el próximo semestre. Con la advertencia de que para el cumplimiento de esta orden no se debe desvincular al médico Arévalo del programa que allí mismo adelanta, pues, la responsabilidad, en este caso, recae únicamente en el proceso irregular de ingreso llevado a cabo por la Universidad.
- Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
