Primero. REVOCAR la sentencia proferida el 30 de enero de 2001 por el Juzgado
Segundo. Penal del Circuito de Ciénaga -Magdalena- y en su lugar CONFIRMAR el fallo del 29 de diciembre de 2000 proferido por el Juzgado
Primero. Penal Municipal de Ciénaga, por las razones expuestas en esta decisión.
Segundo. ORDENAR al gerente general de la Empresa Solidaria del Estado Hospital Local San José de Pueblo Viejo, que, si aún no lo ha hecho, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, proceda a cancelar los salarios que se adeudan a la actora. De no ser posible su cumplimiento por razones netamente presupuestales o de manifiesta iliquidez, deberá informar al Despacho Judicial respectivo en forma motivada, debiendo dentro del mismo término proceder a iniciar los trámites necesarios que deberán culminar con el pago en un término máximo de tres (3) meses.
Tercero. SOLICITAR al Ministerio de Salud y a la Secretaría de Salud del Departamento del Magdalena que gestionen las medidas pertinentes para lograr normalizar la situación que dió origen a la presente tutela.
Cuarta. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
