- Primero. CONFIRMAR el fallo de fecha 25 de julio de 1996, proferido por la Sala de Casacion Penal de la h. Corte Suprema de Justicia, mediante el cual se confirma la Sentencia de primera instancia proferida por el Tribunal Superior de Tunja, Sala Penal, de fecha 14 de junio de 1996, que declaro improcedente la accion de tutela interpuesta por la apoderado judicial del senor Gobernador de Boyaca, contra el Juez Laboral del Circuito de Tunja, pero por las razones expuestas en esta providencia.
- Segundo. ORDENAR que por la Secretaria General de esta Corporacion, se comunique esta providencia al Tribunal Superior de Tunja, Sala Penal, en la forma y para los efectos previstos en el articulo 36 del decreto 2591 de 1991.
