- Primero. REVOCAR la sentencia de segunda instancia proferida por la Sala Civil y Agraria de la Corte Suprema de Justicia, por medio de la cual confirmó la negativa de acceder a la tutela. En su lugar, CONCEDER el amparo del derecho al debido proceso a JAVIER DARIO VELASQUEZ JARAMILLO.
- En consecuencia, SE REVOCA la sentencia proferida por la Sala Disciplinaria del Consejo Superior de la Judicatura, por medio de la cual se sancionó con destitución al actor.
- Segundo. Dese cumplimiento a lo previsto por el artículo 36 del Decreto 2591 de 1991.
