- Primero. REVOCAR la sentencia proferida por el Juzgado
- Primero. Penal del Circuito de Ocaña y, en su lugar, TUTELAR el derecho de petición de la accionante.
- Segundo. ORDENAR al Instituto de Seguros Sociales - Seccional Santander que, si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia proceda a pronunciarse de fondo sobre el objeto de la petición formulada por la Señora MARGARITA CLARO JURE en escrito radicado en octubre 22 de 2004.
- Tercero. PREVENIR al I.S.S. para que en el futuro se abstenga de incurrir en actuaciones que vulneran el derecho fundamental de petición de sus afiliados por inobservancia de los términos vigentes sobre la materia.
- Cuarto. Por Secretaría, líbrense la comunicación de que trata el artículo 36 del decreto 2591 de 1991
