- R E S U E L V E
- PRIMERO. REVOCAR la sentencia del 22 de abril de 1992, proferida por el Juzgado 21 de Instrucción Criminal de Duitama en el proceso de la referencia.
- SEGUNDO. CONCEDER la tutela solicitada por la señora MARIA DE LAS MERCEDES AVELLA DE BECERRA, teniendo en cuenta que la respectiva acción se ejerció con anterioridad a la construcción del puente peatonal y, en consecuencia, PREVENIR a la Secretaría de Obras Públicas de la Alcaldía Municipal de Duitama, para que en el futuro no vuelva a incurrir en las acciones y omisiones que suscitaron la presente tutela.
- TERCERO. LIBRESE comunicación al Juzgado 21 de Instrucción Criminal de Duitama con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
