- Primero. REVOCAR el fallo proferido por el Juzgado
- Segundo. Civil del Circuito de Cucuta y en su lugar CONFIRMAR el fallo proferido en primera instancia por el Juzgado
- Segundo. Civil Municipal de Cucuta, pero de acuerdo con las consideraciones expuestas e este fallo.
- Segundo. TUTELAR como mecanismo transitorio para evitar un perjuicio irremediable los derechos fundamentales a la educacion vida y salud. Por lo tanto, ORDENAR a la Alcaldia Municipal, a sus dependencias de Obras Publicas y al Departamento de Planeacion Municipal, para que dentro de los treinta (30) dias siguientes a la notificacion de la presente sentencia, adopte las medidas encaminadas a garantizar la seguridad en las instalaciones de dicho plantel educativo, a fin de buscar la proteccion de las aguas lluvias que como consecuencia de los aguaceros anegan las instalaciones de dicho plantel educativo.
- Tercero. ORDENAR a las mismas autoridades municipales, para que adelan los tramites pertinentes, para incluir dentro del presupuesto municipal del proximo ano, las partidas presupuestales destinadas a solucionar de manera definitiva el problema de aguas lluvias que afectan dicha zona de la ciudad.
- Cuarto. SOLICITAR a la Personeria Municipal de Cucuta verificar el cumplimiento del presente fallo.
- Quinto. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
