- Primero. REVOCAR la sentencia proferida dentro del expediente T-99.081, por la Sala Penal del Tribunal Superior de Santafé de Bogotá, y en consecuencia CONCEDER la tutela del derecho de petición del señor Marco Aquilino Rojas Castillo, ordenando al Fondo de Ahorro y Vivienda Distrital -FAVIDI-, entidad que tramita la solicitud elevada por el demandante, que en un término de cuarenta y ocho (48) horas, contadas a partir de la comunicación de esta providencia, de respuesta a la petición formulada por el actor.
- Segundo. COMUNICAR a través de la Secretaría General de la Corte Constitucional, el contenido de la sentencia a la Sala Penal del Tribunal Superior de Santafé de Bogotá, y, al Fondo de Ahorro y Vivienda Distrital FAVIDI.
