en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E :
Primero. Revócase el numeral
primero. del fallo de tutela de fecha 21 de abril de 1994, proferido por el Juzgado Catorce Laboral del Circuito de esta ciudad, por medio del cual ordenó reconocer la reliquidación pensional e incluir en nómina al actor.
Segundo. En su lugar, concédese la acción de tutela y en consecuencia, se ordena a la Caja Nacional de Previsión Social de esta ciudad, que dentro del término de cuarenta y ocho (48) horas, contados a partir de la notificación de esta sentencia, resuelva la solicitud de reliquidación pensional presentada por el señor Oscar Ramírez Tamayo, si para la fecha de esta decisión no lo ha hecho.
Tercero. Confírmase el numeral
segundo. del fallo de tutela sometido a revisión, que negó el pago de las mesadas atrasadas.
Cuarto. Comunicar el contenido de esta decisión al Juez Catorce Laboral del Circuito de esta ciudad, el cual notificará la sentencia de esta Corte a las partes y adoptará las decisiones necesarias para adecuar su fallo a lo dispuesto por ésta, de conformidad con el artículo 36 del decreto 2591 de 1991.
