- PRIMERO. REVOCAR la sentencia de la Corte Suprema de Justicia, Sala de Casación Civil, del 16 de diciembre de 2002 y en su lugar CONCEDER la tutela a los derechos fundamentales al libre desarrollo de la personalidad y la libertad de escoger profesión u oficio del señor Juan Carlos Sierra Gómez.
- SEGUNDO. ORDENAR a la Fuerza Aérea Colombiana que en diciembre de 2004 autorice el retiro de la institución del señor Juan Carlos Sierra Gómez, teniendo en cuenta lo señalado en la parte considerativa de esta sentencia.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
