en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E :
PRIMERO. REVOCAR el fallo proferido por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá -Sala Penal- de febrero 24 de 1992, mediante el cual confirmó la decisión del Juzgado
Séptimo. Superior de Bogotá que rechazó la acción de tutela formulada por CARLOS ALFONSO REINA CARRILLO.
SEGUNDO. ORDENASE al INSTITUTO DE SEGUROS SOCIALES estudiar y definir nuevamente el caso de la pensión de vejez reclamada por el señor CARLOS ALFONSO REINA CARRILLO teniendo en cuenta rigurosamente los criterios expresados en la parte motiva de esta providencia. Y, para ello, dejar sin efectos las resoluciones 5343 de 1990 y 04148 de 1991 que la habían resuelto inicialmente. La nueva decisión se tomará en el término de quince (15) días hábiles después de la notificación de este fallo.
TERCERO. Por Secretaría General se dará cumplimiento al artículo 36 del Decreto 2591 de 1991 y el Juez de instancia velará por la ejecución de esta sentencia.
